Privacy Statement

The software Application “Absy” is operated by ABSYZ Software Consulting Private Limited (hereinafter “App” or “Absy” or “Platform” or “we” or “our”), having its registered office located at 6th Floor, Shanta Sriram Techpark, behind PSR Prime, DLF Cyber City, Gachibowli, Telangana 500032.
By using the Absy Software Application or its website, as the case may be, you hereby signify your agreement to be bound by Absy’s Conditions of Use. “Absy”, is committed to keeping any and all personal information collected of those individuals that visit our website/application and make use of our online facilities and services accurate, confidential, secure and private. Our privacy policy has been designed and created to assure those affiliated with Absy of our commitment and realization of our obligation not only to meet but to exceed most existing privacy standards.
Therefore, this Privacy Policy Agreement shall apply to the Absy platform/application, and shall govern any and all data collection and usage thereof.

1. Collection of Information

This website/application shall collect various types of information, such as:

  • Voluntarily provided information which may include your name, address, email address, billing and/or
    credit card information etc., which may be used if and when you purchase products and/or services and to
    deliver the services you have requested.
  • Information automatically collected when visiting our website/application, which may include cookies,
    third party tracking technologies and server logs.
Please be rest assured that this platform/application shall only collect personal information that you knowingly and willingly provide by way of surveys, completed membership forms, emails and related methods. It is the intent of this site to use personal information only for the purpose for which it was requested and any additional uses specifically provided on this site.

2. Use of Information Collected

“Absy” may collect and may make use of personal information to assist in the operation of the platform/application and to ensure delivery of the services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from ABSYZ Software Consulting Private Limited. “Absy” may also be in contact with you with regards to completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered.
  • “Absy” does not now, nor will it in the future, sell, rent or lease any of our customer lists and/or names to any third parties.
  • “Absy” may deem it necessary to follow websites and/or pages that our users may frequent in an effort to gleam what types of services and/or products may be the most popular to customers or the general public.
  • “Absy” may disclose your personal information, without prior notice to you, only after entering into an agreement of non-disclosure only if required to do so in accordance with applicable laws and/or in a good faith belief that such action is deemed necessary or is required in an effort to remain in conformance with any decrees, laws and/or statutes or in an effort to comply with any process which may be served upon “Absy” and/or our website.

3. Disclosure of Data

User further agrees that “Absy” may disclose and transfer User Data to third party service providers (including but not limited to data entry, database management, promotions, products and services alerts, delivery services, payment extension services, authentication and verification services and logistics services) (“Service Providers”). These Service Providers are under a duty of confidentiality to “Absy” and are only permitted to use User Data in connection with the purposes specified in herein above.

  1. User(s) agree that “Absy” may disclose and transfer User Data to “Absy”’s affiliated companies and/or their designated Service Providers.
  2. When necessary “Absy” may also disclose and transfer User Data to our professional advisers, law enforcement agencies, insurers, government and regulatory and other organizations.
  3. Any User Data supplied by User will be retained by “Absy” and will be accessible by its employees, any Service Providers engaged by “Absy” and third parties referred above herein, for or in relation to any of the purposes stated also above.
  4. “Absy” may share User Data with third parties, including without limitation, banks, financial institutions, credit agencies, or vendors to enable such third parties to offer their products or services to such Users. While “Absy” shall endeavour to have in place internal procedures to keep User Data secure from intruders, there is no guarantee that such measures/procedures can
    eliminate all of the risks of theft, loss or misuse.

4. Eligibility

As per provisions laid in the Indian Contract Act, you should have completed 18 years of age and be competent to enter into a contract to be able to use the services of the “Absy” application. If you are under 18 years of age who is intending to avail the services of the App should do so through your legal guardian in accordance with the applicable law.
If you are using the App on behalf of any corporation, company, institution, association or other entity, the person should be authorized by such corporation, company, institution, association or other entity to use and access the App.

5. Compliance Requirements

Every User of the platform/Application shall comply with all the applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, notifications issued there under the Exchange Control Manual issued by the Reserve Bank of India, Customs Act, 1962, Information Technology Act, 2000, Prevention of Money Laundering Act, 2002, Foreign Contribution Regulation Act, 1976, Income Tax Act, 1961, Export Import Policy of the Government of India and shall include any amendments, notifications and Rules thereof under the aforesaid enactments applicable for using the App or buying/ selling any product or service through the App.

6. Cookies

“Absy” may use “cookies” to store specific information about the User and track User(s) visits to the Sites. A “cookie” is a small amount of data that is sent to User’s browser and stored on User’s device. If User does not deactivate or erase the cookie, each time User uses the same device to access the Platform, our services will be notified of User visit to the Platform and in turn “Absy” may have knowledge of User visit and the pattern of User’s usage.
Generally, a website/mobile application may use cookies to identify User and allow the website/mobile application to access data such as User’s Registration Information or Account Information, collect statistical information about usage by Users, etc.

7. Security

“Absy” shall endeavor and shall take every precaution to maintain adequate physical, procedural and technical security with respect to our offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure or modification of the user’s personal information under our control.

8. Acceptance of Terms

Through the use of this website/mobile application, you are hereby accepting the terms and conditions stipulated within the aforementioned Privacy Policy Agreement. In addition, your continued use of our website following the posting of any updates or changes to our terms and conditions shall mean that you are in agreement and acceptance of such changes.

9. Contact for Grievance Redressal

The Grievance Officer identified below is in pursuance with the provisions of applicable laws including but not limited to the Information Technology Act, 2000 and the Consumer Protection Act, 2019, and the Rules enacted under those laws.
